These Terms and Conditions, together with our Privacy Policy, Website Terms of Use (for online bookings), and any pre-contract information provided to you (including the “Key Rights Under the EU Package Travel Directive” summary), form the basis of your contract with Irish Travel Gang Limited (company number 782929, registered office, Kildare) (“we”, “us”, “our” or “the Organiser”) and you, the traveller.
Please read these Terms and Conditions carefully as they set out the respective rights and obligations.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:
a) they have read these Booking Conditions and have the authority to and does agree to be bound by them;
b) they consent to the travel organiser’s use of personal data in accordance with the travel organiser’s Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
c) they are over 18 years of age, and where placing an order for services with age restrictions, declares that they and all members of the party are of the appropriate age to purchase those services;
d) they accept financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
1. PURPOSE AND CONTRACTUAL FRAMEWORK
1.1 These terma and conditions ” (“General Conditions”) govern the booking and sale of tourist packages (“the Package” or “Trip”) provided by Irish Travel Gang Limited (“the Organiser”, “we”, “us” or “our”), registered in Ireland, company number 782929, registered office: Kildare.
1.2 The contract was formed by:
1.2.1 These General Conditions;
1.2.2 The booking confirmation;
1.2.3 The published Trip itinerary and package inclusions/exclusions;
1.2.4 Any pre-contract information provided, including the “Key Rights Under the EU Package Travel Directive” summary;
1.2.5 Any special conditions agreed in writing individually.
2. CONTRACTUAL SOURCES & APPLICABLE LAW
This contract is governed by Irish law and transposes the relevant provisions of Directive (EU) 2015/2302 (the “Package Travel Directive”), the Package Holidays and Travel Trade Act, 1995 (Ireland), including any amending or supplemental legislation.
3. DEFINITIONS
Tourist Package/Trip: A pre-arranged combination of at least two travel services (transport, accommodation, car hire, or other significant tourist services) for the same trip, sold or offered at an inclusive price.
Retailer: Any party selling or offering the Package on behalf of the Organiser.
Related Tourist Service: Additional travel services purchased for the same trip, which do not constitute a Package under law.
Customer/You: The person making the booking and anyone else on whose behalf a booking is made.
Further definitions apply as set out in the Irish Package Holidays & Travel Trade Act and per schedule (if applicable).
4. PRE-CONTRACT INFORMATION
4.1 Before booking, Travellers shall be provided with details of the trip, including specific itinerary, total duration in days/nights, exact travel dates (start and end dates), and precise accommodation information such as, alongside the pre-contract “Key Rights Under the EU Package Travel Directive” information pack:
4.1.1 Specific start and end dates of the package; Total duration of the package (e.g., 7 nights, 8 days); Exact travel dates including departure and return dates, and standard check-in (after 3 PM) and check-out (before 11 AM) times for accommodations, unless otherwise specified;
4.1.2 Service levels and group composition;
4.1.3 Total price in Euros (€), payment arrangements, deposit, and balance procedures. All prices are quoted in Euros. For payments made in other currencies, the exchange rate will be determined based on the rate provided by our bank on the day of transaction processing;
4.1.4 Visa/passport/health requirements and travel documents;
4.1.5 Minimum group size (if any);
4.1.6 Insurance requirements (if different to those as required by these Terms and Conditions);
4.1.7 Cancellation, amendment, and transfer terms (if different to those as required by these Terms and Conditions);
4.1.8 How to make complaints (if different to those as required by these Terms and Conditions).
4.2 Pre-contract information forms an integral part of the contract (including the “Key Rights Under the EU Package Travel Directive” summary) and shall not be altered without the Traveller’s agreement.
5. BOOKING PROCESS AND CONTRACT FORMATION
5.1 Bookings may be completed online or via email/phone as specified by us. Correct personal data and any special requests must be provided at the time of booking.
5.2 The contract is effective once you have received a formal booking confirmation.
5.3 Booking on behalf of others: The lead Traveller submits the booking as agent for all names on the booking and is responsible for payment and acceptance of terms.
5.4 The Organiser reserves the right to refuse bookings at its discretion.
6. PAYMENT
6.1 Deposit: A non-refundable deposit of 25% of the total package price is required at booking. The remaining balance must be paid in full no later than 60 days before departure.
6.2 Late Bookings: For bookings made after the balance due date or where required by suppliers, full payment is due at booking.
6.3 Failure to pay: Late or non-payment may result in automatic booking cancellation, loss of deposit, or other charges.
7. PRICE ACCURACY AND CHANGE
7.1 Prices may be altered only as a result of changes in:
7.1.1 Transport costs (e.g., fuel, taxes, port fees),
7.1.2 Taxes or levies imposed on travel services
7.1.3 Exchange rates relevant to the Package.
7.2 Any increase greater than 8% entitles the Traveller to cancel without penalty and receive a full refund. No price increases shall be applied within 20 days before departure. Quoted prices are valid for 30 days from the date of quotation, unless otherwise specified in writing.
7.3 Minor clerical errors do not affect contract validity; such errors will be corrected as soon as notified. Minor changes to the package will be communicated to customers via email as soon as they occur. No compensation will be offered for minor changes that do not significantly affect the nature of the package.
8. PACKAGE INCLUSIONS / EXCLUSIONS
8.1 Only items expressly included in the itinerary or confirmation are part of the Package price.
8.2 The Package typically includes: accommodation as specified, transportation between destinations as outlined in the itinerary, meals as indicated (B-Breakfast, L-Lunch, D-Dinner), and activities listed as “included” in the itinerary. A detailed list of inclusions will be provided with your booking confirmation.
8.3 Exclusions typically include flights to/from destination, visas, personal insurance, “optional extras,” incidentals, and anything not expressly mentioned.
9. PRICE ACCURACY AND CHANGE
9.1 Travellers are responsible for assessing their fitness to participate and must inform the Organiser of any relevant medical or mobility issues before booking.
9.2 Participation requires compliance with any health protocols, including providing a health self-declaration if so requested.
9.3 Special dietary, mobility, or other requirements must be disclosed at booking; reasonable efforts will be made to accommodate but cannot be guaranteed.
10. MINIMUM NUMBERS & TRIP VIABILITY
10.1 Each trip may require a minimum number of participants to proceed. This minimum and the deadline to reach it are confirmed in advance for each trip. If the minimum is not met, we may cancel and refund all monies paid by you in full without deduction. No compensation is payable in these circumstances in accordance with applicable law.
11. CANCELLATION BY THE CUSTOMER (CANCELLATION POLICY)
11.1 If you wish to cancel your booking, you must notify us in writing.
11.2 Cancellation charges apply as follows (unless a different schedule is set out in your trip confirmation)

11.3 Refunds are limited to amounts that are actually recoverable from our suppliers and will be returned net of any non-refundable or unrecoverable supplier costs (including where suppliers impose stricter cancellation/refund terms) and any reasonable administrative or banking charges. If you purchased any “flexible cancellation” or similar options, they will be honoured as stated. Refunds (if any) will be processed within 14 days of our written confirmation of cancellation and calculation of recoverable sums.
11.4 No refunds are available once a trip has commenced for unused services.
11.5 Where a supplier (including a DMC, accommodation provider or activity operator) applies stricter cancellation or refund terms than those set out above, those stricter supplier terms will apply to the relevant component and may further reduce the amount refundable to you.
12. CHANGES OR CANCELLATION BY THE ORGANISER
12.1 The Organiser may cancel or materially alter a Package only in the event:
12.1.1 Minimum numbers are not achieved;
12.1.2 Force majeure or unavoidable events (see below);
12.1.3 Supplier failure (e.g., DMC insolvency).
12.2.2 The Organiser will notify the Traveller promptly of changes or cancellation; a suitable alternative will be offered where appropriate or, if we cancel your Package, you will receive a full refund of all payments made for the Package without deduction.
12.2.3 No compensation is due in cases of cancellation or major changes resulting from force majeure.
13. TRANSFER OF BOOKING
13.1 You may transfer the booking to another eligible person by giving us at least seven (7) days’ notice in writing before the trip commences, subject to any transfer fees or supplier conditions.
13.2 You and the transferee are jointly liable for the payment of any balance due outstanding, and the costs and fees incurred by the transfer.
14. ACCURACY AND MODIFICATION OF SERVICES
14.1 While efforts are made to adhere strictly to the published itinerary and inclusions, the Organiser may modify services for operational/safety reasons, or where a supplier cannot perform as contracted. The Organiser will act with reasonable skill and care and will use reasonable efforts to procure substantially similar alternatives. In case of changes caused by third-party service providers, the Organiser will promptly notify the Traveller and offer suitable alternatives where appropriate.
14.2 If changes materially affect the nature of the Package (as defined by law), the Traveller will be informed in writing and given the right to accept, receive an alternative, or cancel with a refund. The Traveller must respond to such proposed modifications within 7 days of notification, otherwise the changes will be deemed accepted.
15. UNAVOIDABLE OR EXTRAORDINARY CIRCUMSTANCES (FORCE MAJEURE)
15.1 The Organiser is not liable for material non-performance due to circumstances beyond its reasonable control, including but not limited to
15.1.1 Natural disasters, severe weather, epidemics, and pandemics,
15.1.2 Acts of government, war, riot, strike,
15.1.3 Supplier/DMC failure,
15.1.4 Transport disruptions.
15.2 In such events, including unavoidable and extraordinary circumstances, the Organiser will use reasonable efforts to offer suitable alternatives or refunds for unprovided services.
15.3 If unavoidable and extraordinary circumstances occur at the destination or its immediate vicinity and significantly affect the performance of the Package or the carriage of passengers to the destination, you may terminate the contract before the start of the Package without paying any termination fee and receive a full refund of all payments made, without undue delay.
15.4 Where force majeure affects performance after the start of the Package, we will provide appropriate assistance (including information on health services, local authorities, and consular assistance, and helping to make distance communications and alternative travel arrangements). Any price reductions or refunds will be made to the extent required by law and in line with amounts actually recoverable from suppliers for the affected services.
16. OBLIGATIONS AND RESPONSIBILITIES OF THE TRAVELLER
16.1 The Traveller undertakes to comply with all laws and regulations of destination countries, as well as with the Organiser’s guidelines and instructions. The Organiser will provide information about significant local customs, cultural practices, and religious observances that may affect tourist activities or behavior, and the Traveller agrees to respect these local norms.
16.2 Acts that endanger group safety, breach local or Irish/EU law, or cause disruption may result in exclusion from the trip at the Traveller’s cost and without refund.
16.3 You must have valid travel and health documents, necessary visas, vaccinations, and insurance coverage for your trip. Specific health certificates may be required depending on the destination, including but not limited to yellow fever vaccination, COVID-19 vaccination/testing, or other region-specific health documentation. The Traveller is responsible for obtaining and presenting all required health certificates at their own expense. The Organiser will provide guidance on specific health documentation requirements during the booking process.
16.4 You must provide a copy of your passport and any requested documentation at least 60 days before departure to allow time for processing. Where available, the Organiser may provide general guidance on items that are prohibited or restricted in the destination country; however, the Traveller is responsible for ensuring compliance with these restrictions.
16.5 You undertake to act with due care and respect for other participants, staff, and third parties and to abide by instructions provided by us, local DMCs, or authorities.
16.6 Failure to comply with these obligations may result in exclusion from the trip without refund.
17. PASSPORT, VISA, AND HEALTH REQUIREMENTS
17.1 The Traveller is solely responsible for fulfilling all passport, visa, immigration, and health requirements for the duration of the trip. 17.2 The Organiser is not liable if the Traveller cannot travel due to missing or inadequate documentation.
18. INSURANCE
18.1 The Traveller must have appropriate medical and travel insurance for the trip, covering trip cancellation, personal liability, medical, and repatriation costs. Travel insurance is not included in the package price but is available as an optional add-on. Please contact us for more information on insurance options.
18.2 Insurance details must be provided on request and may be required prior to departure.
18.3 Comprehensive travel insurance including medical, baggage, cancellation, curtailment, personal liability, and supplier insolvency cover must be arranged by you before travel. Evidence of adequate insurance coverage must be provided upon request.
18.4 Irish Travel Gang Limited maintains public liability insurance and complies with the insolvency protection requirements of the Package Holidays and Travel Trade Act 1995 (as amended) and applicable regulations.
19. ORGANISER’S OBLIGATION TO PROVIDE ASSISTANCE
19.1 The Organiser shall provide appropriate assistance without undue delay if the Traveller encounters difficulty during the trip, including info about health services, local authorities, consular support, and alternative arrangements.
19.2 Reasonable costs incurred in providing such assistance due to the deliberate or negligent acts of the Traveller may be charged to the Traveller.
20. LIABILITY AND LIMITATION OF LIABILITY
20.1 Our liability is limited to direct losses up to the total price paid for the trip, except for liability for death or personal injury resulting from our own negligence, and subject in all cases to applicable mandatory law and international conventions.
20.2 We are not responsible for loss, damage, or expense arising from unavoidable and extraordinary circumstances, nor for activities you independently arrange outside the official package.
20.3 We are not liable for services not expressly included in your booking, or for personal injury/loss except where Irish law provides otherwise.
20.4 The Organiser is responsible for the proper performance of all travel services set out in the Package, regardless of whether such services are performed by itself or by suppliers, under the Package Holidays and Travel Trade Act and EU Law. Where there is a lack of conformity that is not remedied within a reasonable period, the Traveller is entitled to an appropriate price reduction and, where applicable, compensation.
20.5 The Organiser limits its liability to the price paid for the trip, except for cases of death or personal injury caused by its negligence or that of its employees, agents, or suppliers acting within the scope of their engagement, and subject always to applicable mandatory law and international conventions. This limitation complies with the Package Holidays and Travel Trade Act 1995 and associated regulations.
20.6 The Organiser is not responsible for loss, damage or injury arising from:
20.6.1 Acts or omissions of third parties not associated with the provision of the trip;
20.6.2 Unavoidable and extraordinary circumstances;
20.6.3 Services not included in the contract.
21. Irish Total Payment Protection (topp) Policy Cover
In compliance with The Package Holidays and Travel Trade Act 1995 (Republic of Ireland),
an insurance policy has been arranged with Arcus Solutions, to protect Republic of Ireland customers’
prepayments in the unlikely event of our financial failure, and paid in respect of:
- Travel packages sold by the Policyholder (Irish Travel Gang Limited Company
reg IE782929) to consumers with travel departing from the Republic of Ireland
and the rest of the world.
for: - a refund of such prepayments if customers have not yet travelled, or
- making arrangements to enable the holiday to continue if customers have already
travelled - repatriation of customers as may be applicable, subject to the terms of the insurance
policy.

22. COMPLAINTS AND DISPUTE RESOLUTION
22.1 If you have a complaint during your trip, please notify your tour leader/guide and contact us as soon as possible so that we can attempt to resolve the issue promptly.
22.2 Formal complaints must be submitted in writing to the Organiser within 10 working days of the end of the trip.
22.3 Should a dispute remain unresolved, the Traveller may access an independent dispute resolution scheme (ADR). Details are available on request or via our website (www.irishtravelgang.com). This is without prejudice to the Traveller’s right to seek redress in the Irish courts.
23. DATA PROTECTION
23.1 We act as an independent controller of personal data provided for your booking and will process such data in accordance with applicable data protection laws (including GDPR) and our Privacy Policy. We will share necessary data with our DMCs and suppliers for the performance of your contract and, where relevant, transfer data outside the EEA subject to appropriate safeguards. You may exercise your data rights (access, rectification, erasure, restriction, portability and objection) by contacting us; you also have the right to lodge a complaint with the Data Protection Commission.
23.2 Personal data will be processed by the Organiser in accordance with the Privacy Policy, the General Data Protection Regulation (GDPR), and the Irish Data Protection Act 2018.
23.3 By booking the Package, the Traveller acknowledges that their personal data will be processed as necessary for the performance of the contract and compliance with legal obligations. The legal basis for this processing is Ar25. GOVERNING LAW AND COMPETENT JURISDICTIONticle 6(1)(b) and (c) of the GDPR. 24. PHOTOS, VIDEOS, AND ASSIGNMENT OF IMAGE RIGHTS
24.1 During trips, photos and videos may be taken. Travellers consent to their use for promotional and informational purposes, unless consent is withdrawn in writing.
25. GOVERNING LAW AND COMPETENT JURISDICTION
25.1 These Terms & Conditions are governed by Irish law and any disputes shall be subject to the jurisdiction of the Irish courts.
26. MISCELLANEOUS
26.1 Invalidity of any provision herein does not affect the validity of the remainder.
26.2 The original language of these terms is English; translations are for information only.
26.3 By booking, you acknowledge and accept these Terms & Conditions and confirm that you have suitable travel insurance for your participation.
26.4 Updates or amendments to these Terms & Conditions will be published on the Organiser’s official website.
26.5 Any refund payable on cancellation or material change will be limited to amounts recoverable from suppliers, and unrecoverable supplier costs or non‑refundable elements may be deducted where suppliers enforce stricter refund terms.
26.6 The Pre‑Contract Key Rights Information provided to the Traveller prior to booking forms an integral part of these Terms & Conditions.
